TERMS AND CONDITIONS

New Skin Laserclinic uses the following terms and conditions.

1 General

1.1 In these conditions "New Skin Laserclinic" means New Skin Laserclinic located in Amsterdam, at Ceintuurbaan 231H.
1.2 In these conditions "client" means the person who orders New Skin Laserclinic to treat.
1.3 In these conditions "client" also means his legal representative.
1.4 In these conditions "treatment" means the treatment for the removal of tattoos using the laser and associated devices used by New Skin Laserclinic.
1.5 These conditions form part of every agreement between the client and New Skin Laserclinic.
1.6 These conditions also apply in the event that New Skin Laserclinic engages third parties for the execution of the order.
1.7 The effect of Article 7:404 and Article 7:407 paragraph 2 of the Dutch Civil Code is expressly excluded.
1.8 The sheet "2. General information that you have received with your appointment confirmation (s) together with the general conditions form part of these terms and conditions.
1.9 The sheet "3. General information on laser treatments and contra-indications" that you have received with your appointment confirmation(s) together with the General Terms and Conditions form part of these General Terms and Conditions.

2 Agreement

2.1 The agreement between New Skin Laserclinic and the client involves the client's order to New Skin Laserclinic for treatment.
2.2 New Skin Laserclinic is entitled not to comply with an unreasonable and/or unusual request of the client and may refuse to perform treatment.

3 Consent

3.1 The client grants written , unconditional and unreserved consent to New Skin Laserclinic prior to the execution of the treatment agreement by completing and signing the intake form of New Skin Laserclinic.
3.2. The client grants unconditional and unreserved consent - with due care - for the registration of his personal data and medical data relevant to the treatment and settlement of the treatment.
3.3 New Skin Laserclinic may require the client to confirm his consent in writing.

4 Information

4.1 The client must provide and keep New Skin Laserclinic informed in a timely manner of all information necessary for the proper performance of the agreement.

5 Rates and health insurance

5.1 Rates apply, unless expressly agreed otherwise in writing, for the duration of a calendar year and may be adjusted and/or indexed annually.
5.2 It is the client's responsibility to make sure, in a timely manner, that he is aware of whether and to what extent his insurer will reimburse the treatment. Furthermore, it is the client's responsibility to declare invoices to his insurer or not.

6 Payment

6.1 Client pays for the treatment in cash or by pin before or after she starts treatment or is taken to the treatment room.
6.2 If New Skin Laserclinic treats the client on account, the client ensures full payment within 14 days and the amount is paid to the relevant account of New Skin Laserclinic stating the invoice number and type of treatment.
6.3 Regardless of whether the invoice is reimbursed by the insurer, the client remains at all times obliged to pay the invoice in full and on time, possibly increased by statutory interest and (extrajudicial) costs.
6.4 Payments will first be deducted from the oldest outstanding invoices.
6.5 If the client fails to pay the invoice on time and/or in full following a request or demand by New Skin Laserclinic, the client is in default. New Skin Laserclinic is then entitled to charge the client statutory interest on the invoice amount or the remainder thereof. New Skin Laserclinic is then also authorized without further notice to take debt collection measures. The costs associated with collection (including extrajudicial and other costs) shall be borne by the client.
6.6 In case of late payment, New Skin Laserclinic is authorized to suspend further treatment or only to provide it against immediate cash payment.
6.7 The payment obligation is not suspended because the client files a complaint against New Skin Laserclinic about the invoice and/or treatment, unless New Skin Laserclinic agrees to the suspension of the payment obligation.
6.8 The payment obligation does not lapse if the client terminates the agreement.
6.9 The purchase of a package for the removal of your tattoo involves 5 treatments with the Starwalker MAQX. The purchase of a package for the removal of your permanent makeup involves 3 treatments with the Starwalker MAQX. If you have purchased a package and you possibly choose to pay in installments, you are unreservedly bound to purchase or pay for the entire package. You cannot claim any set-off. If you choose to terminate the package mid-term, you will still owe the payment of the entire package without reservation to New Skin Laserclinic. You will find the term and amount in the description of the invoice. The package of tattoo removal may be paid in up to 3 installments. The package for permanent make-up removal must be paid at once.

7 Cancellation

7.1 In case the patient is unable to attend an appointment, he must cancel it with New Skin Laserclinic no later than twenty-four hours in advance.
7.2 If the patient does not cancel or not in time, New Skin Laserclinic is obliged to charge 50% of the cost of the treatment.
7.3 Appointments must be cancelled by e-mail message. The cancellation is registered at the time the cancellation is received by New Skin Laserclinic. If client wants to cancel her appointment by phone this is within the responsibility of client. New Skin Laserclinic can not be reached by phone, can not be a reason for not canceling the appointment or not in time.

8 Liability

8.1 If in the treatment, including not, not fully or not timely execution of treatment, an event occurs that leads to liability of New Skin Laserclinic, then that liability is limited to the amount which the liability insurance taken out by New Skin Laserclinic entitles. If the insurance does not cover liability for any reason or if New Skin Laserclinic is not covered for liability then New Skin Laserclinic's liability is limited to the amount of the invoice. However, New Skin Laserclinic shall not be liable in the event that at the time the event occurs the client is in default of any obligation to New Skin Laserclinic.
8.2 New Skin Laserclinic cannot guarantee the amount of treatments to achieve the desired result.
8.3 New Skin Laserclinic is not liable for burning, blistering, scarring, skin damage, pigmentation shift or any (rare) skin reaction whatsoever, after or as a result of the laser treatment(s).
8.4 New Skin Laserclinic is not liable for (exacerbated) pigmentation on skin after the treatment(s).
8.5 New Skin Laserclinic is not liable for reduced pigmentation on skin after the treatment(s).
8.6 Piercings , birthmarks, pigmentation, foreign body features, skin abnormalities, or any abnormality on the skin have an increased risk of skin damage from the laser treatment(s). New Skin Laserclinic is not liable for any skin damage and/or skin reaction whatsoever due to the aforementioned body features.
8.7 New Skin Laserclinic has with respect to the client(s) it treats an obligation of effort and not an obligation of result. New Skin Laserclinic will make every effort to achieve the desired result to the extent medically feasible and responsible. New Skin Laserclinic accepts no liability in the event that, despite best efforts, the result turns out not to be achievable. This is in accordance with applicable case law and regulations.
8.8 New Skin Laserclinic is not liable for (aggravated) hair growth by any radiating heat of the laser on other body parts or as a result of shaving the treated body parts.
8.9 New Skin Laserclinic is not liable for reduced hair growth due to any radiating heat from the laser.

9 Complaints

9.1 In case of dissatisfaction or a complaint from the client about the treatment by New Skin Laserclinic, the client immediately reports this, at least within 48 hours. New Skin Laserclinic and the client then both make efforts to come to a solution.
9.2 A complaint as mentioned in Article 9.1 of these general conditions must be submitted by the client by e-mail.

10 Nullity

In the event that any provision of these terms and conditions is void or voidable, this shall not affect the validity of the remaining provisions.

11 Applicable law

The agreement concluded between New Skin Laserclinic and the client, and any further agreements concluded in execution thereof, shall be governed exclusively by Dutch law.

12 Modification

12.1 New Skin Laserclinic reserves the right to amend these terms and conditions at any time.
12.2 Amendments shall be notified to the client in writing or electronically by e-mail and shall take effect one (1) month after the date of such notice, unless otherwise stated in the notice. If the client does not object to the change in the terms and conditions with reasons within one (1) month after the date of the announcement, the client is deemed to have accepted the change. If the client makes a reasoned objection to the change in the terms and conditions within one (1) month after the date of the announcement, this shall constitute grounds for dissolution of the agreement.
