GENERAL TERMS AND CONDITIONS

New Skin Laserclinic uses the following terms and conditions.

1 General

1.1 In these terms and conditions, "New Skin Laserclinic" means New Skin Laserclinic located at Ceintuurbaan 231H in Amsterdam.
1.2 For the purpose of these terms and conditions, "Client" shall mean the person who orders treatment by New Skin Laserclinic.
1.3 For the purposes of these terms and conditions, "Client" shall also be taken to mean the Client's legal representative.
1.4 For the purposes of these terms and conditions, the term "treatment" shall be taken to mean treatment for the purpose of removing tattoos using the laser and associated instruments to be used by New Skin Laserclinic.
1.5 These Terms and Conditions form part of any agreement between the Customer and New Skin Laserclinic.
1.6 These terms and conditions also apply if New Skin Laserclinic engages third parties for the execution of the order.
1.7 The effect of sections 7:404 and 7:407(2) of the Netherlands Civil Code is expressly excluded.
1.8 The sheet "2. General information that you received with your appointment confirmation(s) together with the General Terms and Conditions form part of these General Terms and Conditions.
General information about laser treatments and contra-indications" that you have received with your appointment confirmation(s) together with the general terms and conditions form part of these general terms and conditions.

2 Agreement

2.1 The agreement between New Skin Laserclinic and the Customer includes the Customer's order to New Skin Laserclinic for treatment.
2.2 New Skin Laserclinic is entitled to not comply with an unreasonable and/or unusual request of the Customer and may refuse to carry out a treatment.

3 Consent

3.1 The Customer grants unconditional and unreserved consent in writing to New Skin Laserclinic prior to the execution of the treatment agreement by completing and signing the intake form provided by New Skin Laserclinic.
3.2. The client gives unconditional and unreserved consent - with due care - to the registration of his personal data and medical information relevant to the treatment and the completion of the treatment.
3.3 New Skin Laserclinic may require that the Customer confirms his/her consent in writing.

4 Information

4.1 The Customer shall inform New Skin Laserclinic in a timely manner of all information necessary for the proper execution of the Agreement.

5 Rates and health insurance

5.1 Rates apply, unless explicitly agreed otherwise in writing, for the duration of a calendar year and can be adjusted and/or indexed annually.
5.2 The client is responsible for being informed in a timely manner whether and to what extent his insurer will reimburse the treatment. Furthermore, it is the client's responsibility whether or not to declare invoices to his insurer.

6 Payment

6.1 The client pays for the treatment in cash or by debit card before or after receiving treatment or being taken to the treatment room.
6.2 If New Skin Laserclinic treats the Customer on account, the Customer shall ensure full payment within 14 days and the amount shall be paid into the relevant account of New Skin Laserclinic, stating the invoice number and type of treatment.
6.3 Regardless of whether the invoice is reimbursed by the insurer, the customer is always obliged to pay the invoice in full and on time, plus any statutory interest and (extra-judicial) costs.
6.4 Payments will first be deducted from the oldest outstanding invoices.
6.5 If the Customer does not pay the invoice on time and/or in full after a request or demand by New Skin Laserclinic, the Customer is in default. New Skin Laserclinic is then entitled to charge the customer the statutory interest on the invoice amount, or the remainder thereof. New Skin Laserclinic is then also entitled, without further notice, to take (or have taken) collection measures. The costs associated with the collection (including extrajudicial costs and other costs) are for the account of the Customer.
6.6 In case of payment arrears New Skin Laserclinic is entitled to suspend further treatment or only perform treatment against immediate cash payment.
6.7 The payment obligation is not suspended by the customer filing a complaint against New Skin Laserclinic regarding the invoice and/or the treatment, unless New Skin Laserclinic agrees with the suspension of the payment obligation.
6.8 The payment obligation does not lapse if the Customer terminates the agreement.
6.9 The purchase of a package for tattoo removal concerns 5 treatments with the Starwalker MAQX. The purchase of a package for the removal of your permanent make-up concerns 3 treatments with the Starwalker MAQX. If you have purchased a package and you possibly choose to pay in installments, you are bound without reservation to take or pay the entire package. You are not entitled to set-off. If you choose to stop the package in the meantime, you still owe New Skin Laserclinic the payment of the entire package without reservation. You will find the term and amount in the description of the invoice. The package of tattoo removal may be paid in up to 3 installments. The package for permanent make-up removal must be paid in one time.

7 Cancellation

7.1 In case the patient is unable to attend an appointment, he/she must cancel the appointment with New Skin Laserclinic no later than twenty-four hours in advance.
7.2 If the patient does not cancel or does not cancel in time, New Skin Laserclinic is obliged to charge 50% of the costs of the treatment.
7.3 Appointments must be cancelled by e-mail. The cancellation is registered when the cancellation is received by New Skin Laserclinic. If the customer wishes to cancel the appointment by telephone this is the responsibility of the customer. If New Skin Laserclinic cannot be reached by phone, this cannot be a reason for not cancelling the appointment or not doing so in time.

8 Liability

8.1 If during the treatment, including the non, incomplete or late execution of a treatment, an event occurs that leads to liability of New Skin Laserclinic, then such liability is limited to the amount that the liability insurance taken out by New Skin Laserclinic pays out. If the insurance does not cover liability for whatever reason, or if New Skin Laserclinic is not covered for liability, the liability of New Skin Laserclinic is limited to the amount of the invoice. However, New Skin Laserclinic is not liable if at the time the event occurs, the Customer is in default of fulfilling any obligation towards New Skin Laserclinic.
8.2 New Skin Laserclinic can not guarantee the number of treatments needed to achieve the desired result.
8.3 New Skin Laserclinic is not liable for burning, blistering, scarring, skin damage, pigmentation or any (rare) skin reaction after or as a result of the laser treatment(s).
8.4 New Skin Laserclinic is not liable for (aggravated) pigmentation on skin after the treatment(s).
8.5 New Skin Laserclinic is not liable for reduced pigmentation on skin after the treatment (s).
8.6 Piercings, birthmarks, pigmentation spots, skin abnormalities, or any other abnormality on the skin have an increased risk of skin damage by the laser treatment (s). New Skin Laserclinic is not liable for any skin damage and/or skin reaction resulting from the aforementioned body characteristics.
8.7 New Skin Laserclinic has a best-efforts obligation towards the client(s) it treats, not an obligation to achieve a certain result. New Skin Laserclinic will make every effort to achieve the desired result as far as medically possible and responsible. New Skin Laserclinic accepts no liability in the event that, despite best efforts, the result is not achievable. This is in accordance with applicable case law and regulations.
8.8 New Skin Laserclinic is not liable for (aggravated) hair growth due to possible radiating heat from the laser on other body parts or as a result of shaving the treated body parts.
8.9 New Skin Laserclinic is not liable for the reduction of hair growth by possible radiating heat from the laser.

9 Complaints

9.1 In case of dissatisfaction or a complaint by the Customer about the treatment by New Skin Laserclinic, the Customer shall report this immediately, or at least within 48 hours. New Skin Laserclinic and the Customer then both make an effort to come to a solution.
9.2 A complaint as mentioned in article 9.1 of these terms and conditions must be submitted by the Customer by e-mail.

10 Nullity

In the event that any provision of these terms and conditions is invalid or voidable, this shall not affect the validity of the remaining provisions.

11 Applicable law

The agreement concluded between New Skin Laserclinic and the Customer, and any further agreements entered into for the purpose of executing the agreement, are governed exclusively by Dutch law.

12 Modification

12.1 New Skin Laserclinic reserves the right to change these terms and conditions at any time.
12.2 Amendments will be communicated to the Customer in writing or electronically by e-mail and will take effect one (1) month after the date of publication, unless stated otherwise in the publication. If the Customer does not object to the amendment to the Terms and Conditions, stating reasons, within one (1) month after the date of the announcement, the Customer shall be deemed to have accepted the amendment. If the Customer objects to the amendment of the terms and conditions, stating reasons, within one (1) month after the date of the announcement, this will constitute grounds for dissolution of the Agreement.
